Came across a bit harsh in my argument about warbuton last night. I was off my head. Take no heed.
That said I still agree with the points I made. The reason someone will be banned for longer for an outrageous spear tackle is that they are potentially fatal. A stamp to the ankle or leg happens near enough every game with the worst outcome being a break, not to trivialise it however its still a terrible injury , but no matter what way you paint it a stamp will never harbour the same potential to cause harm that a spear tackle can
A proper spear tackle maybe, i.e. twisting and drilling him into the ground with the tacklers full weight behind it, but don't automatically think that what Warburton did is anywhere near as dangerous just because the IRB has decided not to differentiate.
What Warburton did isn't half as dangerous as taking the support lifters out in a lineout, as the jumper often ends up in the same position as a tip tackle, but from an extra 6+ft in the air. However this isn't the IRB's pet dislike at the moment, so offenders usually escape with a mere penalty against them.
Warburton's tip tackle was reckless, but something which is going to happen from time to time when you have a small winger run into a backrower who is set low ready to drive upwards. Nothing wrong with Warburton's intentions, just mistimed and panicked half way through. Very difficult to rescue the incident once the attackers weight has passed the horizontal. I accept the red-card, as I'm sure Warburton does, but there was no malicious intent.
The refs should be given some leeway as to how they interpret whether or not any maliciousness was involved in the spear tackle. Warburton's tackle was obviously lacking in malice, it was just unfortunate and it should have been a penalty. I had some spanner jump into the tackle once in a game. He went straight over my shoulder, head first into the ground. I was sin binned and the ref apologised to me, but said he had no choice.
Apart from the fact that there was no attempt by Warburton to drive Clerc back, he planted his feet took Clerc way beyond the parallel and dropped him, a definite red card, even though there may have been no malice in it, the intent to hurt the opponent in the tackle was and a red card and a ban were deserved, as LN7 put it Clerc could have died or had a career ending or paralyzing injury.

How can you intend to injure without any malice? That is literally the definition of malice.
I don't know how you could implement the subjectivity, because it is so subjective.
But punishing people who tackle with good intentions does not reduce the likelihood of them doing it again if they didn't mean to do it in the first place.
Well, as I'd like to see a BOD and Tuilagi 12/13 partnership, I would love to see BOD get the captaincy. He has proven how great he is as a leader and I think he would be inspiring to the younger players in the team. He always sets a great example too. It would be a fantastic way for him to end his international career as well.
