I think it's one of those ref's interpretations - Wayne likes a good metre or so away from the back foot before he'll allow it - but he'd probably allow a kick forwards.

I've even seen cases where he's called "ball out" a defender dives on it, and gets pinged for doing so (he'd have been allowed to pick it up, but not to dive on it).
