I think the ref is going by the letter he knows from his reaction that May meant absolutely nothing by it and it was purely accidental. Most marginal of yellows.

Based on explanation by Wayne Barnes pre-match discussion the consequences are to be determined by intent.

What was the tacklers intent?
In this instance there was no intent - therefore penalty NOT yellow.
Suspect Angus Gardner being too officious and not using common sense.
